SKV Wins Dismissal for Forum Non Conveniens

 

SKV lawyers Lee Kaplan and Hector Chavez and our co-counsel Ray Thomas, P.C. from McAllen won a significant dismissal in federal court. On October 17, the District Court for the Southern District of Texas dismissed Sultana Entertainment, LLC v. Eliseo Robles Gutierrez, et al.  Plaintiff claimed to be the exclusive U.S. representative of the Mexican band “La Leyenda” and complained that once he took the band “from 0 to 60” they thanked him by “throwing him under the tour bus.”  Unfortunately for Plaintiff, the underlying contract which Plaintiff’s alleged predecessor had with the artists contained an exclusive forum selection clause requiring adjudication of contractual disputes in Monterrey, Nuevo Leon, Mexico and a choice of law clause requiring the application of the law of the State of Nuevo Leon. After extensive briefing and discovery, the Court granted the motion and dismissed the case.
