SKV successfully represented the nation’s largest railroad in a series of arbitrations against one of the country’s largest electric power generation corporations that resulted in a favorable global settlement on the first day of the first arbitration hearing.
The dispute arose out of the power generation company’s decision to close multiple midwestern coal-fired generation plants and the impact that decision had on its rail transportation agreements. In order to present the dispute to the arbitral panels, the SKV team, led by Craig Smyser, Justin Waggoner, and Alex Wolf and including associates Samantha Jarvis and Rick Houghton, unraveled the complex electricity capacity market and the maze of environmental regulatory issues impacting the electrical power and rail transportation industries.
