On November 21, 2017, SKV lawyers Dane Ball, Sam Jarvis, Kristin Adler, and Tony Phillips obtained a complete dismissal for one of the industry’s largest and most recognized residential housing providers after it was accused of criminal water pollution.
The State initially sought to file over a dozen felony water pollution charges alleging a significant unlawful sewage discharge into a Texas waterway over the course of several days.
SKV conducted an internal investigation, including extensive witness interviews, site visits, and document review. Based on the information learned in that investigation, SKV convinced the State that felony charges would be inappropriate. SKV then successfully negotiated a pretrial intervention agreement calling for a single misdemeanor charge against a subsidiary company which, with no admission of guilt, would be dismissed after six months of no additional violations.
The misdemeanor has now been dismissed, bringing the company’s case to an end with no criminal conviction of any kind.
